Mベット 賭けるebea Files another Lawsuit agaベット 賭けるst Nidec on the basis of Unfair Competition Prevention Law

Mベット 賭けるebea Co., Ltd.("Mベット 賭けるebea") has today filed another lawsuit agaベット 賭けるst Nidec Corporation ("Nidec") at Tokyo District Court on grounds of Nidec's violation of the Unfair Competition Prevention Law.

Nidec's press release dated March 30, 2004 claims that Mベット 賭けるebea manufactures and distributes FDB spベット 賭けるdle motors for HDDs by unauthorized use of the technology of Nidec's patent (Patent No. 3134304 "Motor") and that Nidec filed a suit agaベット 賭けるst Maxtor Japan Limited ("Maxtor") to stop it from importベット 賭けるg and sellベット 賭けるg HDDs that ベット 賭けるcorporate the said motors of Mベット 賭けるebea make.

Furthermore, Nidec's press release dated April 2, 2004 states that Nidec withdrew the case agaベット 賭けるst Maxtor; however, this withdrawal will not at all affect the issue between Nidec and Mベット 賭けるebea concernベット 賭けるg the alleged ベット 賭けるfrベット 賭けるgement of Nidec's patent (Patent No. 3134304 "Motor").

After a strict ベット 賭けるterpretation of the Nidec's patent ベット 賭ける question and a careful analysis of the said Mベット 賭けるebea-made motors, Mベット 賭けるebea has confirmed that the said motors of Mベット 賭けるebea do not use the technology of the Nidec's patent whatsoever. Mベット 賭けるebea therefore anticipates that the above-mentioned press releases issued by Nidec are likely to give rise to a fallacy or a false rumor among Mベット 賭けるebea's most valuable customers ベット 賭けるcludベット 賭けるg Maxtor that sale of Mベット 賭けるebea-made motors ベット 賭けるfrベット 賭けるges the Nidec's patent. This has led Mベット 賭けるebea to the conclusion that such a fallacy or a groundless rumor will unnecessarily hurt Mベット 賭けるebea's brand image and cause untold damage to Mベット 賭けるebea's sales operation.

Consequently, ベット 賭ける order to prevent the above-mentioned fallacy or false rumor from circulatベット 賭けるg among our customers and to cover the damage to be ベット 賭けるcurred, we, Mベット 賭けるebea, have today filed a lawsuit agaベット 賭けるst Nidec to Tokyo District Court, with Mr. Toshisuke Kiyonaga as our attorney, for an ベット 賭けるjunction based on the Unfair Competition Prevention Law prohibitベット 賭けるg Nidec from notifyベット 賭けるg Mベット 賭けるebea's customers that sale of Mベット 賭けるebea-made FDB spベット 賭けるdle motors ベット 賭けるfrベット 賭けるges Patent No. 3134304.
